With the continuous spread of Coronavirus (COVID-19) and its impact on public health, business owners are urged to stay up to date on the amended employment laws.  Whether employees are calling out due to illness or childcare complications, it is vital for employers to know how these new laws affect their business and their employees.  For those employers with less than 500 employees, H.R. 6201 Families First Coronavirus Response Act [1] has expanded the Family and Medical Leave Act (FMLA).  Under Division C – Emergency Family and Medical Leave Expansion Act, there now exists emergency paid leave benefits as it relates to COVID-19.  This new enactment allows an employee (employed for at least 30 calendar days by employer) to take emergency leave from work for reasons related to COVID-19 The emergency paid leave under §102(a)(1)(F), may consist of unpaid leave for the first 10 days.  Beyond that, the employer provides p

Learn More about RON As social distancing becomes more common due to the COVID-19 Remote Online Notarization (RON) may be a resourceful tool. As of January 1, 2020, Florida has passed a law that authorizes the notarization of documents using an online platform. RON will allow a notarial act to be completed without the need of the same physical location as the Notary Public.  To conduct a RON, both signer and Notary must be in a RON platform. An electronic format of the document will be uploaded into the RON platform. The platform has the audiovisual technology that allows the notary to see, hear, and communicate with the signer. If the signer is not in the state of Florida, the notary public confirms that the signer wants document notarized by a Florida Notary and under Florida Law. Once the Notary Public verifies the Notary Public identity and Notary is confident that the signer is not being coerced and is mentally competent both the signer and Notary sign the docume

IS COVID-19 COVERED UNDER FORCE MAJEURE IN YOUR CONSTRUCTION CONTRACT?

With the perpetual spread of coronavirus (COVID-19), businesses are on high alert with their course of business activities, the effect on their employees and clients, and their contractual obligations.  A vital clause to revisit in a business’ contract is force majeure. A force majeure is a contractual clause found in most construction contracts.  This clause will excuse the performance of a party or parties when an unforeseeable circumstance or event occurs that is beyond the control of the contracting parties.  Unforeseeable events may include war, influenza outbreaks, governmental action (such as mandated shutdown), or Acts of God (such as hurricanes or earthquakes).  COVID-19 may be considered a type of force majeure, dependent on the contractual force majeure language in a contract and the performance being prevented by the virus.   During these times, it is vital for businesses to revisit their contractual relationships and recognize not only their rights, remedies,
